1 TERMS AND CONDITIONS

1.1 DEFINITIONS

1.1.1 The term “Devils Detail” refers to the owner of the website whose registered office is: African Tree, Javakade 746 1019 SH, Amsterdam, The Netherlands. African Tree is a company registered in the Netherlands under the number: KvK 58302476 (Commercial Register of the Chamber of Commerce in Amsterdam).

1.1.2 T-shirts: Products displayed for order on web store http://devilsdetail.nl and available for purchase by the Customer.

1.1.3 The Customer: a person that orders t-shirts via devilsdetail.nl.

1.2 These general Terms and Conditions govern all contracts, supplies and other services agreed between the Customer and Devils Detail and apply to every offer and any agreement concluded at a distance between Devils Detail and the Customer.

1.3 By placing an order, the Customer agrees to be bound by these Terms and Conditions and also warrants that is over 18 years old and is legally capable of entering into binding contracts.

1.4 The Customer’s own general terms and conditions shall not be accepted, unless Devils Detail has indicated otherwise in writing.

1.5 Devils Detail reserves the right, at its sole discretion, to make changes to any part of the website. Devils Detail may wish to change these terms as a result of its policy of updating and improving the website.

2 ENTERING INTO A CONTRACT

2.1 After placing an order, the Customer will receive an email from Devils Detail acknowledging that Devils Detail has received the Customer’s order. This email is not an acceptance of the Customer’s order but only a confirmation that the Customer’s order has been received by Devils Detail. All orders are subject to acceptance by Devils Detail. Devils Detail is entitled to refuse, or impose special conditions upon a supply, subject to giving reasons. If Devils Detail is unable to clearly establish the Customer’s delivery address, an order cannot be accepted. Devils Detail will confirm acceptance of the order to the Customer by sending an email in which Devils Detail confirms that the Goods have been dispatched and the payment was successfully made. Therefore the contract between Devils Detail and the Customer will only be formed when Devils Detail sends the email confirmation to the Customer stating that the t-shirts have been dispatched and the payment was successfully made.

2.2 Order processes that for whatever reason have been technically or otherwise disrupted before the payment has been booked on Devils Detail bank account, are incomplete, even if the Customer has received an order confirmation. Such order will therefore not be accepted. Devils Detail shall endeavor, however, to contact the Customer to assist with completing the payment so that delivery can be made.

2.3 The products in the Devils Detail web store are intended for individuals and may not be sold to a third party.

3 PRICES AND COSTS

3.1 The contract price is the current price at the moment when an order is placed with the Devils Detail web store. The prices of t-shirts are quoted inclusive of VAT.

3.2 The prices quoted in the Devils Detail web store are inclusive of delivery- and administrative costs.

3.3 Devils Detail is not bound by the terms of its offer in the event that there is any obvious mistake in the offer or any other printing, typesetting or programming fault on Devils Detail website.

4 FULFILLING ORDERS

4.1 Devils Detail shall act with the greatest possible care in processing orders for t-shirts.

4.2 T-shirts shall be delivered to the address given by the Customer. Devils Detail requires that the delivery address is the same as the Customer’s address defined on Transaction Details Page.

4.3 Devils Detail shall dispatch accepted orders as quickly as possible in the order in which they are received. Your order will be delivered by PostNL within 2 working days in The Netherlands. For Europe it can take up to 3-5 days, for outside Europe it can take up to 1 week of delivery time. We are not liable for delays of delivery due to PostNL. All shipments are standard registered and sent as parcel post with Track & Trace code. You will receive a Track & Trace code when your order has the status “sent”.

4.4 The delivery term indicated by Devils Detail is approximate and there is no right to compensation if actual delivery takes longer.

5 CUSTOMS, DUTIES AND TAXES

5.1 When ordering from Devils Detail, the Customer is responsible for assuring that the product can be lawfully imported to the destination country. The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside the European Union may be subject to import taxes, customs duties and fees, which are levied once a shipment reaches the recipients country. Additional charges for customs clearance must be borne by the recipient; Devils Detail has no control over these charges and cannot predict what they may be.

5.2 Devils Detail advises the Customer to contact the local customs office for current charges before placing an order, to prevent unexpected charges.

6 RETURNS POLICY

6.1 The Customer is entitled to return any t-shirts to Devils Detail within fourteen (14) days of its delivery, without need to give any reason. This right does “not” extends to t-shirts that have been reduced in price. This has the effect of canceling the purchase of these t-shirts and the Customer will be refunded the amount already paid to Devils Detail for the said t-shirts. Please note that Devils Detail will not refund the shipping cost for the returned t-shirts. The risk of return is the Customer who returns the shipment.

6.2 Prior to sending a return, the Customer must write an email notice to info@devilsdetail.nl providing the order number of the returning t-shirts. Your return shipment will be confirmed by e-mail. The amount of the returned items will be credited to your credit card or refunded to your bank account This happens within 14 working days after receipt of the return.

If you want to exchange your items we charge you the costs for sending your new order and the costs for the new ordered (exchanged) t-shirt. We cannot guarantee that the t-shirt is still available if you want to exchange. If we can’t exchange we will refund the amount to you.

6.3 The shipping address for returned t-shirts is:

6.4 No refund will be made in respect of t-shirts returned to Devils Detail after the said fourteen-day period.

6.5 T-shirts must be returned in accordance with the following instructions:

6.5.1

The T-shirt needs to be returned within 14 days of receipt of the order.
The T-shirt must still have original labels attached and needs to be returned in original, new, unused state and packaging as much as possible.
T-shirts are non-returnable if:
They have been carried and/or washed;
They are damaged and/or you have tried to restore the damage or a defect;
The user manual and/or user instruction has not been followed up.
There are traces of smoke, perfume etc.
For a quick settlement, we ask to fill in the return form clearly and completely

Colors: Devils Detail made efforts to display t-shirt colors accurately on devilsdetail.nl. However, as computer monitors vary, Devils Detail cannot predict if the Customer’s monitor displays colors accurately.

6.6 Devils Detail is entitled to refuse to accept a returned Goods or to send it back to the Customer if the t-shirts appear to have been used, no longer carry the original labels, reveal damage caused by the Customer, or if the Customer does not comply with the instructions for returning the t-shirts given by Devils Detail.

7 ERROR IN DELIVERY

7.1 If Devils Detail delivers t-shirts different to those ordered, or if the t-shirts are damaged, the Customer must notify Devils Detail of this as soon as possible by sending an email to the following email address: info@devilsdetail.nl. Devils Detail shall reimburse the purchase price plus any delivery charges.

8 FORCE MAJEURE

8.1 Devils Detail shall not be liable to the Customer or deemed to be in breach of contract as a result of any delay in performing or failure to perform any of its obligations in relation to t-shirts arising from any cause beyond its reasonable control.

8.2 If Devils Detail is unable to perform its obligations under the contract due to a cause beyond its reasonable control Devils Detail shall give the Customer a written notice of this fact as soon as reasonably practicable after discovering it.

8.3 If the inability to perform its obligations under the contract due to a cause beyond Devils Detail’s reasonable control continues for two months after the Customer receives notice then either the Customer or Devils Detail may give written notice without liability to the other to terminate the contract.

9 COMPLAINTS

9.1 If Customer wishes to exchange or return t-shirts, they must follow the instructions specified in our Terms and Conditions’ article 6: Returns Policy.

9.2 Other queries, comments or complaints relating to an order, payment or delivery should be sent in writing to the following email address: info@devilsdetail.nl.

9.3 The email message must contain the Customer’s full name, email address and if applicable the order number included in the order confirmation.

10 PAYMENT

10.1 The Customer’s payment will be handled by Mollie/ Paytor.

7. PICK UP: Unfortunately it is not possible to visit us to pick up products. We have an agreement with POST NL and your package will be sent via mail order.

8. ON ACCOUNT: we do not offer a possibility to pay on account.

11 PRIVACY

11.1 In placing an order, the Customer grants Devils Detail the right to use their personal details where necessary. These details will be kept only as necessary to achieve the goals by Devils Detail, i.e. for performance of the contract, for marketing purposes and for maintaining contact with the Customer.

11.2 Information Devils Detail collects:

11.2.1 Information that the Customer provides by filling in forms on devilsdetail.nl site. This includes information provided at the time of registering to use the site, subscribing to services or requesting further services. If the Customer contacts us, Devils Detail may keep a record of that contact. Reflect Online may also ask the Customer to complete surveys that Devils Detail uses for research purposes, although the Customer does not have to respond to them.

11.2.2 Details of transactions the Customer carries out through Devils Detail‘s site and details of the fulfillment of the Customer’s orders.

11.2.3 Details of the Customer’s visits to Devils Detail’s site including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for Devils Detail’s billing purposes or otherwise and the resources that the Customer accesses.

11.3 No Disclosure to third Parties

Devils Detail will not make the Customer’s personal data available to third parties, with the exception of Devils Detail’s service partners who may require the data for processing the Customer’s order, e.g. shipping companies, banks or credit check agencies. In these cases, data disclosure to such parties will be limited to the minimum required.

If the Customer prefers not to have their personal data used, processed and transmitted for internal marketing purposes, they must inform Devils Detail about that by sending an email to info@devilsdetail.nl. This will not apply to information Devils Detail holds to process the Customer’s order. After receiving the Customer’s revocation, their data will be used for the sole purpose of processing their order and not for marketing or advertising actions.

11.4 Cookies

11.4.1 Devils Detail utilizes so-called “cookies”. These are data stored on the Customer’s computer allowing their computer to be recognized upon contact (hard-drive cookies). The Customer may set-up their browser to have it delete cookies from the hard-drive, block all cookies or to warn the Customer before a cookie is stored. In certain circumstances, however, deletion of a cookie may prevent to make use of all services provided by Devils Detail.

12 INTELLECTUAL PROPERTY RIGHTS

12.1 Customer acknowledges and agrees that all copyright, designs, the “look and feel” of the site, trademarks and all other intellectual property and material rights relating to the content as herein described, including Devils Detail software and all HTML and other code contained in this site, shall remain at all times vested in Devils Detail and/or are the property of their respective owners. The Customer is permitted to use the content only as expressly authorized by Devils Detail and/or its third party licensors.

13 NO COMMERCIAL USE

13.1 This site is for Customer’s personal non-commercial use only. Customer may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products, or services contained within this site. Customer may not use this site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site.
